- Udok (Proprietary) Limited ("We") are committed to protecting and respecting your privacy. This policy sets out the basis on which any Personal Information we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand how we collect and use your Personal Information.
- The use of our services or engaging with us may require that we be able to collect, hold, process, use and disclose your Personal Information on the basis described in this policy. This policy may change from time to time. While we will endeavour to notify you of any such changes, it is your responsibility to confirm that you have read and understood the latest version of these terms.
- Reference to “consent”, “your consent” or “your explicit consent”, shall include the ticking of a tick box or clicking on a “submit” button or “I agree” button on our website.
COLLECTION AND PROCESSING OF YOUR PERSONAL INFORMATION
- The types of Personal Information we collect about you and the sources from which we receive such information are as follows:
- ● Personal Information you give to us directly: You may provide us with Personal Information about you when you submit forms to us or otherwise directly engage with us (including via our website or directly with any of our representatives), or which you provide to us in connection with the contracts we have with you, such as your name, contact details, age and identity number;
- ● Personal Information we collect from you: With each of your visits to our website we may automatically collect the following information from you:
○ Technical information such as the Internet Protocol (IP) Address used to connect your computer to the Internet, your login information, browser type and version, time-zone setting, browser plug-in types and versions, operating system and platform. Your IP Address is automatically logged by our servers and used to collect traffic data about visitors to our website. We do not use your IP Address to identify you personally; and
○ Information about your visit to our website such as the full Uniform Resource Locators (URL) Clickstream to, through and from our website (including the date and time), Services you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and Mouse-overs) and methods used to browse away from the page and any phone number used to call our Customer Service number. - ● Personal Information we receive from other sources: We may receive Personal Information about you from third parties, for instance:
○ public registers, credit bureaus, money laundering, fraud prevention and law enforcement agencies,
○ as well as our business partners and the persons employed by us to provide services for us, which may include debt collection services, communications services and data hosting, processing and management services, and
○ from such other persons as you may consent to or which may legally be entitled to provide us with information about you. - We may retain your Personal Information for as long as we are permitted or obliged by law to do so.
USE OF YOUR PERSONAL INFORMATION
- We collect and will process your information for us to be able to pursue and manage our engagements with you, as well as to pursue our legitimate interests as well as those of our partners and suppliers. This includes processing for the following purposes:

- ● to process your applications for our services, including to verify whether you qualify for our services, which may include verifying your identity, status, contact details, financial track record, and to ensure that the information we receive and hold about you is accurate, complete and up to date;
- ● carry out our obligations arising from any contracts entered into between you and us (or selected third parties) and to provide you with the information, products and Services that you request from;
- ● to comply with legal and regulatory requirements, for audit purposes and legal proceedings;
- ● notify you about changes to our (or selected third parties’) products or Services;
- ● ensure that Content from our website is presented in the most effective manner for you and for your computer; and
- ● deal with enquiries and complaints made by or about you relating to our website or your use thereof.
- ● to administer our website and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;
- ● to allow you to participate in interactive features of our Service, when you choose to do so;
- ● as part of our efforts to keep our website safe and secure; and
- If you provide information on behalf of someone else, then it is your responsibility to obtain the necessary consent from such person/User before making the information available to us. On receipt of Personal Information we assume that the necessary consent has been obtained and will process the Personal Information as per your instructions. By submitting such Personal Information on behalf of another person/User, you indemnify us against any third party claim, where such third-party claim relates to Personal Information which has been processed without the necessary consent or other available exception by law.
- We may use your Personal Information for historical, statistical and research purposes, and will ensure that such use does not involve the publication of such information in identifiable form.
- Certain information about you which we hold and which we do not need for the above purposes, such as the information for which you have provided to us consent to use, will only be used for the purpose specifically consented to. This includes:
- ● to inform and provide you with the opportunity to make use of services and benefits that we offer and that we believe may be of interest to you; and
- ● For such other purposes as you may consent to from time to time.
- Please note that we will not contact you telephonically for unsolicited marketing purposes or send unsolicited marketing communications to you by mail, facsimile, SMS or electronic mail if you have objected to receiving such communications by way of a public register recognised for such purposes by law or by notifying us of your objection in the prescribed manner. We will provide you with reasonable opportunities to object to receiving marketing communications in the manner prescribed by law, including upon your application to subscribe to our services and on each occasion when we send you such communications.
- We will not use or distribute your Personal Information in any other manner or for any other purpose unless we are legally required or permitted to do so.

DISCLOSURE OF YOUR PERSONAL INFORMATION
- Save as set out below, we will not transfer your Personal Information to a third party without your consent unless legally obliged thereto. You acknowledge that we may share with or transfer your information to the following people and organisations in pursuit of the processing purposes set out in this policy:

- ● to any person to whom we cede, delegate, transfer or assign any of our rights or obligations pertaining to the services provided by us or contracts concluded by us;
- ● to any person that acts as your executor of your estate, curator or in a similar capacity;
- ● to any third party we appoint to exercise or enforce any of our rights or obligations that we have under any agreement we have with you;
- ● to such other persons as may be required or permitted by applicable law or that you may consent to;
SECURITY AND STORAGE OF YOUR PERSONAL INFORMATION
- We will strive at all times to ensure that records of your Personal Information will always be protected against unauthorised or accidental access, processing or loss. We maintain this commitment to data security by implementing appropriate reasonable technical and organisational measures to safeguard and secure your information, including by using appropriate cryptographic techniques and access control mechanisms. If we use a third party to host, manage or process your data on our behalf we will require that such third party also commit to implementing appropriate reasonable technical and organisational measures to safeguard and secure your information
- If we are not prevented by a law enforcement or regulatory agency, we will notify you as soon as practicably possible in writing and at your registered postal or email address if we believe that unauthorised access to your information may have occurred, providing you with such information as you may reasonably require to implement protective measures.
- Please note that our sharing of your information may involve the transfer thereof to third parties outside of South Africa. In such instances we will ensure that we are legally permitted to do so and will require that the third party recipient of your information also subscribes to protecting your information on principles similar to the principles of this policy.
COOKIES
- Our website makes use of cookies to help us understand our Users better. Cookies allow us to better understand which Users have seen which web pages and advertisements, to determine how frequently particular pages are visited and to determine the most popular areas of our website. Depending on the type of cookie we use, cookies also allow us to make our website more User friendly, for example, permanent cookies may allow us to save your password so that you don't have to re-enter it every time you visit our website.
- You should be able to adjust your browser so that your computer does not accept cookies. If you do this, you will still be able to browse the website but the functions that allow you to access an existing account or page that requires a username or password will not be available.

INTERCEPTION AND MONITORING OF COMMUNICATIONS
- We reserve the right to intercept, monitor, copy or block communications to and from our communications facilities (including, but not limited to, our website, portal, email, SMSs, etc.) in accordance with the relevant provisions of the law.
YOUR RIGHTS
- Provided that you give us suitable and adequate proof of your identity, you have the right:

- ● If our right to process your Personal Information requires your consent, to withdraw such consent at any time, provided that this shall not affect the lawfulness of processing which occurred prior to such withdrawal;
- ● to object to the further collection, use, sharing or processing of your personal information by us at any time where such processing activities are not required by us to comply with our obligations under any agreement we have with you, to exercise our rights, or for such other purposes as may be required or permitted by applicable law; and
- ● to require us to correct, erase or cease processing information or records we hold about you and for which we require your consent to process, or that we are no longer permitted to retain, or which are inaccurate, irrelevant, excessive, out of date, incomplete, misleading or has been unlawfully obtained.
- Any of the above can be done by contacting us directly by any means provided by us, including by submitting a written request to us via email at admin@udok.co.za. We will notify you of the steps taken as a result of your request. We will not be obliged to provide you with information or agree to your request to the extent that we are prohibited thereto by applicable law, if compliance would unreasonably prejudice our legitimate interests or that of a third party, or if we have a legal basis upon which to deny your request. Please note that we may require a reasonable period to comply with your request.
COMPLAINTS
- You have the right to submit a complaint to the Information Regulator (South Africa) regarding an alleged breach of the conditions for lawful processing of personal information as set out in Protection of Personal Information Act No. 4 of 2013(POPIA).

DEFINITIONS
- ● Clickstream means a series of mouse clicks made by you while accessing the Internet, specifically our website;
- ● Companies Act means the Companies Act, Act 71 of 2008 (as amended);
- ● Content means any information, content, images, video, audio, data, works of authorship, materials, software and technology which may be displayed on, incorporated into, underlying, or used to operate our website;
- ● Internet Protocol (IP) Address means a set of numbers which are assigned to the User’s computer during a browsing session whenever the User logs onto the Internet via the User's internet service provider or the User's network (if the User access' the Internet from, for example, a computer at work);
- ● Mouse-over means the action whereby certain information is displayed when a User hovers their computer mouse pointer over a specific area and information is displayed by way of a pop-up box;
- ● PAIA means the Promotion of Access to Information Act, Act 2 of 2000 (as amended);
- ● Personal Information shall have the same meaning attributed to it in terms of the POPI Act;
- ● POPI Act means the Protection of Personal Information Act, Act 4 of 2013;
- ● Services means the services provided by us which includes, without limitation, the provision of a platform as a service website to act as access point to a database of healthcare professionals and all services ancillary to the aforesaid; and
- ● Users mean users of our website (including you!).
